Terms of Service for HobbyMonitor LLC

1. Acceptance of Terms

By accessing and using HobbyMonitor.com, our iOS and Android apps, HobbyMonitor Collect (collect.hobbymonitor.com), the HobbyMonitor Desktop Scanner for Windows (beta), our AI assistant connector, our games (such as Bowmystery and CardCrush), and the public Gallery (together, "the Service"), you agree to be bound by these Terms of Service provided by HobbyMonitor LLC ("we", "us", or "our").

2. Description of Service

HobbyMonitor.com and associated mobile applications provide tools and information for tracking trading card prices (sports, Pokemon, One Piece and other trading cards), releases, and market trends. The Service includes market price tracking, grading estimates, release date monitoring, card information lookup features, personal card collection management, optional price and release alerts via push notifications and email, an optional connected eBay seller account for creating and managing your listings, and AI-powered market analysis.

2.1 Beta Features

Certain features of HobbyMonitor, including HobbyMonitor Collect, are currently in beta. By using beta features, you acknowledge and agree that:

• Beta features may change, be modified, or discontinued without notice
• Data stored during beta may be subject to resets, migrations, or format changes as we improve the service
• While we make every effort to preserve your data, beta periods carry inherent risks
• Beta features are provided "as-is" with limited support
• Feature availability and limits may change as we refine the product
• We welcome your feedback at feedback@hobbymonitor.com to help improve the service

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your account information
• Accept responsibility for all activities under your account

3.1 Eligibility and Age

You must be at least 13 years old to use the Service. If you are under 18 (or under the age of majority where you live), you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms for you.

You must be at least 18 (or the age of majority where you live) to buy a paid plan or to connect an eBay account.

If we learn that an account belongs to a child under 13, we delete the account and its data.

4. Communications and Email Preferences

By creating an account, you consent to receive communications from us via email including:

We will send you essential service-related emails that are necessary for account and service operation:

• Account verification and security notifications
• Subscription confirmations, renewals, and billing notifications
• Password reset and security-related alerts
• Critical service announcements and Terms/Privacy Policy updates
• Responses to your support inquiries

These communications are essential to your use of the Service and cannot be disabled.

4.2 Optional Marketing Communications

With your explicit consent, we may send you optional marketing and promotional communications including:

• Product announcements and new feature updates
• Platform enhancements and improvements
• Educational content about card collecting, market trends, and platform usage
• Special offers, promotions, and events
• Community updates and user spotlights

Your choice: Marketing communications require your explicit opt-in consent. You may:

• Opt-in during account registration or later in your profile settings
• Update your email preferences at any time in your account settings
• Unsubscribe from marketing emails using the unsubscribe link in any promotional email
• Contact our support team to modify your communication preferences

Opting out of marketing communications will not affect essential account-related communications as described above.

5. Subscription Plans and Billing

HobbyMonitor offers various subscription plans that provide enhanced features and tools across our website and mobile applications. By subscribing to a paid plan, you agree to the following terms:

• Subscription fees are charged in advance on a monthly or annual basis depending on your selected plan
• Your subscription will automatically renew at the end of each billing cycle unless cancelled
• Price changes will be communicated at least 30 days before taking effect
• You authorize us to charge your payment method for all subscription fees
• You are responsible for all applicable taxes in addition to the subscription fee
• Web subscriptions: Premium is $5.99/month or $60.00/year, and Pro is $12.99/month or $125.00/year. In-app prices may vary by store and region

5.1 Subscription Features

Different subscription tiers (Free, Premium, and Pro) include varying levels of access to features such as:

• AI-powered market analysis and card pricing allowances
• Card scanner analysis credits
• Personal collection storage limits
• Prospect watchlist slots
• Premium content access
• Ad-free experience

5.1.1 HobbyMonitor Collect Limits

The card collection feature includes the following tier-based limits:

Feature availability and limits are subject to change with notice to subscribers.

5.2 Cancellation and Refunds

You may cancel your subscription at any time. Web subscriptions are canceled in Profile > Manage Subscription. Subscriptions purchased through the Apple App Store or Google Play are billed, canceled, and refunded through Apple or Google, so cancel them in your store subscription settings:

• Cancellations take effect at the end of your current billing period
• No refunds will be issued for partial subscription periods
• No refunds are provided for annual subscriptions after purchase
• After cancellation, you will continue to have access to paid features until the end of your billing period
• Deleting your account cancels a web subscription, but does not cancel an App Store or Google Play subscription; cancel those in the store

5.3 Payment Processing

We use third-party payment processors for subscription billing. By subscribing, you agree to the applicable processor's terms of service and privacy policy. We do not store any credit card details on our servers. All payment information is processed and stored directly by the payment processor.

iOS and Android in-app purchases are processed through the Apple App Store and Google Play respectively. Mobile payment information is handled directly by Apple or Google and is not stored by us.

5.4 Free Trials & Free Tier

We may offer a free trial or a perpetual free tier with limited features:

• Web free trials last 7 days, require a payment method, and are limited to one trial per account. They convert to a paid plan at the end unless cancelled before the trial ends.
• For App Store purchases, you must cancel at least 24 hours before the trial or renewal date to avoid being charged, under Apple's rules.

6. User Content

Users are responsible for any content they submit to the Service. Content must not:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Contain harmful or malicious content
• Include spam or unauthorized commercial content

6.1 Card-Related Content Only

Our AI-powered features (including card scanning and grading analysis) are designed specifically for trading card-related content. By using these features, you agree to:

• Only upload images of trading cards for scanning and analysis
• Only submit card-related queries
• Not upload personal photos, non-card images, or unrelated content
• Use the service only for legitimate trading card collecting purposes

6.2 Collections Data

Our card collection management feature allows you to store and organize information about your personal card collection. By using this feature, you agree to:

• Only store information about cards you own or are tracking
• Accept responsibility for the accuracy of entered data (purchase prices, grades, etc.)
• Understand that collection data is stored indefinitely until you delete it
• Acknowledge that public collection sharing makes your collection visible to anyone with the link, and it may appear in the public Gallery if "Show in Gallery" is on (new public collections are included by default). Your username is public
• When using CSV import: accept responsibility for the accuracy of imported data, and understand that imported data is subject to the same content moderation as manually entered data

Important: Free tier collections are always public. If you require private collections, please upgrade to a paid subscription.

6.3 Content Moderation

To maintain a safe community, all user-submitted content is subject to automated moderation:

• Collection names, descriptions, and card images are screened for inappropriate content
• Content that violates our policies (including harassment, hate speech, illegal content, and explicit material) will be rejected
• Accounts repeatedly submitting prohibited content may be suspended
• We use AI-powered moderation tools; if you believe your content was incorrectly flagged, you may appeal by contacting support@hobbymonitor.com

7. Prohibited Activities

The following activities are strictly prohibited:

• Attempting to manipulate market data or prices
• Using automated systems to scrape or collect data without permission
• Creating multiple accounts for abusive purposes
• Interfering with the proper operation of the Service
• Attempting to access restricted areas of the Service
• Sharing account access with unauthorized users
• Circumventing subscription limitations or paywall features
• Uploading non-card related images to our AI scanning features
• Attempting to reverse engineer or extract data from AI responses
• Using the service to generate content that violates intellectual property rights

8. Indemnification

You agree to indemnify, defend, and hold harmless HobbyMonitor LLC, its officers, directors, agents, and employees from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your use of the Service.

9. Export Compliance

You will not use the Service in violation of U.S. export laws or sanctions, and you represent that you are not located in, under the control of, or a national or resident of any restricted country.

10. Third-Party Services and Advertising

The Service integrates with third-party services including:

• Authentication providers for account sign-in
• AI service providers for card identification, grading estimates, market analysis, and image processing
• Data providers for pricing research and market information
• Cloud infrastructure providers for hosting, API gateway, and edge services
• Payment processors for web and mobile subscription billing
• Analytics providers for usage tracking and service improvement

Use of these services is subject to their respective terms and conditions. Card grading estimates and AI-generated results are provided as guidance only and should not be considered as official grades or professional advice.

10.1 AI Service Data Processing

When you use our AI-powered features:

• Card images, queries, and related data may be processed by third-party AI providers according to their respective data retention policies
• HobbyMonitor retention: Scan images are stored with your scan records for up to 1 year; scan metadata is retained for the same period
• AI providers may retain processed content for a limited period (typically up to 30 days) according to their own policies
• No personally identifiable information (email, payment info) is intentionally shared with AI providers
• All AI-generated results are for informational purposes only and should not be considered definitive

10.2 Usage Analytics

We use analytics tools to track usage patterns, feature adoption, and user experience on our site. By using our Service, you consent to the collection and processing of this information to help us improve our platform. We track:

• Pages and features you interact with
• User journey flows and navigation patterns
• Performance metrics and error rates
• Feature usage statistics

We associate this data with your user account when you are logged in to provide a more personalized experience. For more information about our data practices, please refer to ourPrivacy Policy.

10.3 Affiliate Disclosure

When you click links to various merchants on this site and make a purchase, this can result in this site earning a commission. Affiliate programs and affiliations include, but are not limited to, the eBay Partner Network and the Topps affiliate program (through Impact).

10.3.1 Connected eBay Account

If you connect an eBay seller account, you authorize us to create, edit, and end listings, manage offers and Promoted Listings, and read your order and financial data on your behalf, subject to eBay's own terms. You are responsible for the accuracy and legality of listings you create through the Service, for compliance with eBay's policies, and for your own tax obligations. Sales, fee, and profit figures we display are estimates for your convenience; eBay is the system of record. You may disconnect at any time, which revokes our access.

10.4 Advertising

This site displays third-party advertisements (Google AdSense) to logged-out visitors and users on our free plan. These advertisements are clearly identified and may be based on your interests and browsing activity. Premium and Pro subscribers receive an ad-free experience as part of their subscription benefits.

11. Intellectual Property

All content and materials available on HobbyMonitor.com and associated mobile applications, unless otherwise noted, are protected by copyright and other intellectual property laws owned or licensed by HobbyMonitor LLC. Users may not copy, reproduce, or distribute content without permission.

11.1 Copyright Complaints (DMCA)

We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on the Service infringes your copyright, send our designated agent a written notice that includes:

• Your physical or electronic signature
• The copyrighted work you believe is infringed
• The material you believe is infringing and where it appears on the Service (for example, the page link)
• Your name, address, phone number and email address
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act for the owner

When we receive a valid notice, we remove or disable access to the material and tell the account that posted it.

If your content was removed and you believe that was a mistake or a misidentification, you may send our designated agent a counter-notice. It must include your physical or electronic signature; the material that was removed and where it appeared; a statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification; and your name, address and phone number, with a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any district where HobbyMonitor LLC may be found) and that you will accept service of process from the person who sent the original notice. If we receive a valid counter-notice, we may restore the material 10 to 14 business days later, unless the person who sent the original notice tells us they have filed a court action.

We end the accounts of users who repeatedly infringe copyright, in appropriate circumstances.

12. Termination

We reserve the right to:

• Suspend or terminate your account for violations of these terms
• Modify or discontinue any aspect of the Service
• Remove any user content at our discretion
• Cancel any subscription at our discretion (in cases where we terminate service due to terms violations, we may, at our sole discretion, provide a pro-rated refund for unused service periods)

13. Severability & Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and HobbyMonitor LLC regarding your use of the Service, superseding any prior agreements.

14. Dispute Resolution

Any disputes arising from the use of our Service will be resolved through:

• Initial informal negotiation
• Mediation if negotiation fails

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Massachusetts, and you hereby consent to the personal jurisdiction and venue of such courts.

For Massachusetts residents: In accordance with Mass. Gen. Laws ch. 93A (Consumer Protection Act), you have the right to pursue claims in state court and/or file complaints with the Massachusetts Attorney General's Consumer Protection Division.

15. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. Market data and price information are for reference only and we do not guarantee their accuracy.

16. Limitation of Liability

HobbyMonitor LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

17. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Continued use of the Service constitutes acceptance of modified terms.

18. Changes to the Service

We may modify, suspend, or discontinue any feature of the Service at any time without notice or liability. We will endeavor to provide reasonable notice for major feature removals or deprecations.
